These Terms of Service ("Terms") govern your use of the Panelario website (panelario.com), the free web-based Panelario Viewer, the paid desktop application, and the manufacturer listing service (collectively, the "Service"). By accessing or using the Service you agree to these Terms.
Panelario ("we", "us", "our") is a parametric surface design tool. Payments are processed by LemonSqueezy (Lemon Squeezy, LLC) as Merchant of Record.
The Viewer requires no account. Panelario desktop and manufacturer services require a valid email address. You are responsible for keeping your login credentials and licence keys confidential.
Upon purchase, we grant you a perpetual, non-exclusive, non-transferable licence to install Panelario on up to two (2) machines (e.g. office + laptop), but only one instance may run at a time. The licence is tied to your email address and activated via machine fingerprint.
Panelario requires online activation on first launch. A machine fingerprint (one-way hash of hostname, username, and OS) is stored to enforce the 2-machine limit. Only one instance may run at a time — starting the application on a second machine while it is running elsewhere will be blocked. You can deactivate a machine via the customer portal to free up a slot.
Your licence includes free updates for 12 months from the date of purchase. After that, you may continue using the last installed version indefinitely. Future updates require an active maintenance subscription or a paid upgrade to the next major version.
Refund requests are handled by LemonSqueezy in accordance with their refund policy. We offer a 14-day money-back guarantee from the date of purchase, provided the software has not been activated on more than one machine.
Any business may register a free manufacturer profile. Registration requires a valid company email address, verified via a confirmation link.
Free listings receive up to 10 quote requests at no charge. After the 10th quote request, the listing becomes hidden until you activate a paid plan. We will notify you when you approach the limit.
The Partner plan (€100/month or €1,000/year) provides unlimited quote requests, web and social media links, and listing statistics. There are no visual differences on the map between free and paid listings.
You are responsible for ensuring that your listing information (company name, location, materials, capabilities) is accurate and up to date. We reserve the right to remove listings that are misleading, inactive, or violate these Terms.
Customers may leave reviews after a completed quote request. You may respond to reviews but may not delete them. We reserve the right to moderate reviews for spam, abuse, or content that violates these Terms.
You retain full ownership of all Content you create using the Service. We do not claim any rights to your designs, exports, or data.
By using the "Share" or "Request Quote" features, you grant us a limited licence to transmit your design parameters and preview image to the intended recipient (manufacturer or collaborator).
You are solely responsible for all shapes, patterns, texts, and designs you create, export, or share using the Service. Panelario is a general-purpose parametric design tool — the creative output is entirely your own. We do not review, moderate, or approve user-generated designs.
We bear no liability for any claims, damages, or legal consequences arising from the content of your designs, including but not limited to: offensive, defamatory, or otherwise objectionable shapes or texts; designs that infringe third-party intellectual property rights; or any use of exported files in manufacturing, construction, or other applications.
Panelario, its source code, noise algorithms, UI design, documentation, and branding are owned by Panelario and protected by copyright and intellectual property laws. These Terms do not grant you any rights to our trademarks or branding.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY. WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not warrant that the Service will be uninterrupted, error-free, or free of harmful components. You use the Service at your own risk.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL PANELARIO OR ITS AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR BUSINESS OPPORTUNITIES, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE.
OUR TOTAL AGGREGATE LIABILITY SHALL NOT EXCEED THE AMOUNT YOU HAVE PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
You agree to indemnify and hold harmless Panelario from any claims, damages, losses, or expenses (including legal fees) arising from your use of the Service, your Content, or your violation of these Terms.
We may suspend or terminate your access to the Service at any time if you violate these Terms. Upon termination:
Sections 6 through 10 survive termination.
These Terms are governed by and construed in accordance with the laws of the Czech Republic. Any disputes shall be resolved by the competent courts in the Czech Republic.
We may update these Terms from time to time. Material changes will be communicated via the email address associated with your account or licence. Continued use of the Service after changes constitutes acceptance.
